Firearms, cartridges, bullet clips, explosives, chemical substances associated with weapons, ammunition, munitions, and other weapons.( Unauthorized buying and selling such items in M&amp;eacute;xico is a federal crime carrying severe penalties.)&lt;br /&gt;* Narcotics and other street drugs.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Customs&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span&gt;* Tourists are allowed to enter Mexico with their personal effects and other articles necessary for their stay &lt;br /&gt;in the country. The Customs General Office distributes brochures describing duty-free articles.&lt;br /&gt;* Upon entry to M&amp;eacute;xico, declare all electronic equipment valued at more than 50 dollars. You could be asked &lt;br /&gt;to provide a receipt for each item showing the value&lt;br /&gt;* Carrying, possessing, selling or transporting weapons without a permit is a federal offense in M&amp;eacute;xico.&lt;br /&gt;* Importing hunting weapons requires an updated permit, which may be granted by any Mexican consulate.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Water concerns&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span&gt;As opposed to mainland M&amp;eacute;xico, Baja California&amp;#39;s water has been considered safe for years. In addition, &lt;br /&gt;there is a Mexican federal law stating that restaurants must serve purified, &amp;quot;drinkable&amp;quot; water, tested free of &lt;br /&gt;contaminants both for drinking and for ice.&lt;br /&gt;Most Hotels in Baja California also provide bottled or purified water in guest rooms and popular international &lt;br /&gt;brands of bottled water are available for purchase virtually everywhere.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;On the road&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-size:14px;line-height:17px;"&gt;* Make sure to have a valid driver&amp;rsquo;s license and registration for your vehicle.&lt;br /&gt;* Car insurance is not mandatory but it&amp;rsquo;s highly recommended. There are many companies along the USA-Mexico border that sell Mexican car insurance by the day, week or month. Keep in mind that most US insurance policies don&amp;rsquo;t provide coverage while driving in Mexico. &lt;font color="#ff0033" size="2"&gt;(MLSbaja.com NOTE: Even though not mandatory, please understand that WITH Mexican Insurance, should you be involved in a collision, or worse, your insurance adjuster will immediately be dispatched to the scene to act on your behalf, just ask the police to do so.&amp;nbsp; Without a policy, your vehicle will most likely be impounded immediately with no certainty on when or how you will get it back....GET INSURANCE!)&lt;br /&gt;&lt;/font&gt;* Be aware that speed limits in M&amp;eacute;xico are set in kilometers (1 mile= 1.6 kms.) for example speed limit on highways is 55 Miles per hour and within city limits it averages 25 miles per hour.&lt;br /&gt;* While driving respect and obey traffic signs, don&amp;rsquo;t drink and drive.&lt;br /&gt;* It is a traffic violation to use a cellular phone wile driving in the state of Baja California&lt;br /&gt;* Always use your seatbelt.&lt;br /&gt;* If your car breaks down, turn on your flashers and raise the hood.&lt;br /&gt;* If you must abandon your car, park safely and keep all passengers together.&lt;br /&gt;* Along certain Mexican roads and highways you will find military checkpoints where you may be subjected to a routine search. Please cooperate, be patient and before you know it, you will be on your way.&lt;br /&gt;* Do not advertise you are a visitor. Place maps, travel brochures and valuables in the glove compartment or trunk once you get to your destination. Carry wallets, checkbooks and purses with you.&lt;br /&gt;* Always lock your car and take the keys. Don&amp;rsquo;t hide a spare key on your vehicle.&lt;br /&gt;* Never leave your vehicle with the engine running.&lt;br /&gt;* Park in well-lighted, busy areas.&lt;br /&gt;* Whenever you stop overnight, remove bags and other valuables from the car and take them to your room.&lt;br /&gt;* If your vehicle is stolen, you should immediately call our Tourist Assistance Hotline 078 they will direct you on how to go about filing a report with the Deputy DA Office (Ministerio Publico). Just show any document that proves ownership of the stolen vehicle. The Deputy DA will take a report and open an investigation.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;u&gt;&lt;span style="font-size:14px;line-height:17px;"&gt;&lt;strong&gt;Green Angels&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/u&gt;&lt;span style="font-size:14px;line-height:17px;"&gt;They will provide FREE road assistance to visitors in case of a vehicle malfunction while on Mexican highways. Tickets issued in Tijuana can be paid in the USA with a check or money order made out to: H. Ask that a policeman and a police accident investigator come to the scene. If you have any questions, call the Tourist Assistance Hotline 078.&lt;br /&gt;* Do not move the vehicles that are involved in the accident and wait for the police accident investigator to arrive at the scene.&lt;br /&gt;* You should call your vehicle insurance company representative.&lt;br /&gt;* Once the police accident investigator has determined who&amp;rsquo;s at fault, you will be asked to go to the nearest police station, to discuss with other party involved possible mutual settlement agreement concerning payment for repairs, thus avoiding the State DA&amp;rsquo;s office&lt;br /&gt;* At the police station, if necessary, you have the right to ask for an attorney.&lt;br /&gt;* If someone is injured in the accident, no matter how slightly, the person alleged to have been at fault must go before the State DA&amp;rsquo;s Office.&lt;br /&gt;* You should find out if your medical insurance policy applies when traveling abroad or overseas. (Note : Most drugs that are restricted in the U.&lt;br /&gt;S. are also restricted in Mexico.)&lt;br /&gt;* Drunk driving or being under the influence of drugs.&lt;br /&gt;* Causing an auto accident or injuring someone.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;If you are arrested, you should call our Tourist Assistance Hot Line 078 and ask them to notify the &lt;br /&gt;Consulate from your country. &lt;/strong&gt;&lt;/span&gt;&lt;span&gt;Consular officers can work to protect your legitimate interests. They can &lt;br /&gt;provide you with a list of local attorneys, contact your family or friends, transfer money, food and clothing to &lt;br /&gt;detention centers.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Shopping:&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span&gt;Baja California offers you excellent shopping options. Most times prices are lower than the U.S. especially in &lt;br /&gt;fragrances, jewelry, art objects, cosmetics and Textiles, you will find the best of all the art crafts from all &lt;br /&gt;regions of M&amp;eacute;xico: high quality ceramics, guitars, blown glass, wrought iron and silver, among others.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Taxes:&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span&gt;The sales and service tax, is known as the Value Added Tax (IVA) and is 10% of the bill. In Mexico , as in the U.S. , the transfer of real estate property rights are administered by federal, state and local laws. Foreign nationals wishing to acquire property are subject to permission and registration with Mexico&amp;#39;s Department of Foreign Affairs. Very simply, the seller didn&amp;#39;t own the property or he had not completed the required development procedures for the conveyance of the real estate. A good example would be agrarian land (&amp;quot;&lt;em&gt;ejido&amp;quot;&lt;/em&gt;) not properly regularized, or the conveyance of a condominium unit that does not have a recorded condominium regime (&lt;em&gt;regimen de condominio&lt;/em&gt;) or even the sale of a lot or house in a residential subdivision (&lt;em&gt;fraccionamiento&lt;/em&gt;) that does not have the required and published state/municipal development approvals. The first two are preliminary agreements containing the basic transactional information. They are not the instruments by which title to the property is transferred to the buyer. The second contractual document is the agreement to be protocolized by the notario which will transfer title to the buyer. It may have several different forms: a real estate trust agreement (&lt;em&gt;contrato de &lt;/em&gt;fideicomiso), a reserve title agreement (&lt;em&gt;contrato de compraventa con reserva de dominio&lt;/em&gt;) or an assignment of real estate trust rights (&lt;em&gt;contrato de cesion de derechos fideicomisarios&lt;/em&gt;). The Civil Code defines an agreement (&lt;em&gt;convenio&lt;/em&gt;) as an accord (&lt;em&gt;acuerdo&lt;/em&gt;) between two or more persons to create, transfer, modify or extinguish obligations. Specifically, the Civil Code defines contracts as an agreement that produce or transfer obligations and rights. In general, real estate contracts in Mexico must be protocolized before a notary public and, to be binding on third parties, they must be filed with the public registry of property. Once there is a written acceptance to the offer, it is recommended that the buyer&amp;#39;s attorney draw up the sales contract or promissory agreement. Since this agreement is the single most important document the buyer will execute with the seller, and the agreement&amp;#39;s contents will determine the terms and conditions of the transaction, the buyer should insist that his attorney assume this responsibility.&lt;/font&gt;&lt;/font&gt;&lt;/span&gt;&lt;span style="color:black;"&gt;&lt;font face="Arial, Helvetica, Sans Serif"&gt;&lt;font size="2"&gt;&amp;nbsp;&lt;/font&gt;&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span&gt;&lt;strong&gt;&lt;font face="Arial, Helvetica, Sans Serif"&gt;&lt;font size="2"&gt;Major difference between US and Mexican transactions&lt;/font&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span style="color:black;"&gt;&lt;font face="Arial, Helvetica, Sans Serif"&gt;&lt;font size="2"&gt;There are many aspects of Mexican real estate deals that are very similar to transactions closed in the United States. It is easy to presume that the basic terms and principals with which a purchaser is familiar in the US also hold true in Mexico. However, a foreign buyer is much better off to assume nothing. Two such terms are escrow (&lt;em&gt;plica&lt;/em&gt;) and earnest money deposit. In the United States, an escrow or title company, or a person legally empowered to act as an escrow agent, will serve in the capacity of handling escrow functions and earnest monies. In either case, the company or individual whom carries out the escrow procedure is licensed and empowered by law to do so. They are legally responsible to see that the agreed upon conditions of an escrow agreement are met before any funds are released. This is &lt;strong&gt;not &lt;/strong&gt;the norm in Mexico. Historically, foreign purchasers have given earnest money as contractual consideration to the seller. And in many cases, the real estate agent or broker involved in the transaction has served as an escrow agent. Real estate brokers are not licensed in Mexico and typically do not set-up separate accounts for earnest money deposits. The caveat here is expressly made in bold letters. &lt;strong&gt;If a foreign buyer is willing to give earnest money to the seller or the real estate agent in the transaction, be prepared not to get it back! &lt;/strong&gt;&lt;/font&gt;&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span style="color:black;"&gt;&lt;font face="Arial, Helvetica, Sans Serif"&gt;&lt;font size="2"&gt;&amp;nbsp;&lt;/font&gt;&lt;/font&gt;&lt;/span&gt;&lt;span style="color:black;"&gt;&lt;font face="Arial, Helvetica, Sans Serif"&gt;&lt;font size="2"&gt;Only until very recently have a couple of Mexican escrow companies come into existence utilizing US bank accounts for earnest money deposits. In Mexico , all real estate transactions and the legal conveyance of any type of property involve the participation of the notario publico. Although their title translates to &amp;#39;public notary&amp;#39;, the notario publico&amp;#39;s responsibilities greatly exceed the formalization of signatures. Appointed by the Governor of the State and the Executive Branch of the federal government for a particular state district, notarios are attorneys that must pass two extensive examinations in order to receive their lifetime appointments. In a typical transaction, they will prepare the deed of conveyance subject to the &amp;#39;protocolized&amp;#39; purchase-sale agreement. The notario brings buyer and seller together for the formalization of the property transfer and they authorize the appropriate signatures upon execution of the escritura. And lastly, after the property transfer has been formalized, the notario will record the escritura with the public registry of property where the property is located. Prior to the closing, the notario&amp;#39;s additional duties include: (i) to examine the documents of the selling party to ensure their accuracy and legitimacy; (ii) to verify title; and (iii) to search the public records to determine the status of the seller&amp;#39;s title to the property and the existence of liens against the property. The notario is also responsible for the collection of all applicable property taxes and government transfer taxes. As a representative of the State, however, the notario does not insure title to the real estate nor do they have any legal responsibility for title defects. In short, a purchaser can not seek restitution against a notario in the event the purchaser suffers a monetary loss due to a title defect unless fraud, misrepresentation or gross negligence could be proven in a Mexican court of law.&lt;/font&gt;&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span style="color:black;"&gt;&lt;font face="Arial, Helvetica, Sans Serif"&gt;&lt;font size="2"&gt;&amp;nbsp;&lt;/font&gt;&lt;/font&gt;&lt;/span&gt;&lt;span&gt;&lt;strong&gt;&lt;font face="Arial, Helvetica, Sans Serif"&gt;&lt;font size="2"&gt;What about buying property in the &amp;#39;prohibited zone&amp;#39;?&lt;/font&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span style="color:black;"&gt;&lt;font face="Arial, Helvetica, Sans Serif"&gt;&lt;font size="2"&gt;Title to all real estate in the &amp;#39;prohibited zone&amp;#39; being acquired by foreign purchasers can only be legally vested and recorded one of two ways: (i) in a Mexican bank trust (&lt;em&gt;fideicomiso&lt;/em&gt;) for all residentially declared property; or (ii) in a Mexican corporation for all non-residential real estate. There is no in-between choice or &amp;#39;gray area&amp;#39; concerning foreign acquisition in the restricted zone &lt;strong&gt;&lt;em&gt;(100 km. along all borders, 50 km. along all coastlines, all of Baja California)&lt;/em&gt;&lt;/strong&gt; of Mexico . Foreign nationals can be the sole and exclusive stockholders of a Mexican corporation that holds fee simple title to non-residential property in the prohibited zone. In any type of real estate acquisition in Mexico , non-Mexican purchasers must always register their ownership interest with the Secretary of Foreign Affairs and must waive their rights to foreign government intervention in the event of a property dispute. This is known as the Calvo Clause, which is constitutionally mandated, and is contained in all bank trust agreements. It should be noted that Mexican banks, acting as trustee for a foreign buyer in a fideicomiso, make no warranty or guarantee of the title to the property in the trust nor do they provide any restitution in the event of a title defect. Foreign buyers should always be advised to consult US or Mexican counsel regarding real estate transactions. They also can contact US title companies to assist them in answering questions about conveyance issues, title searches and title policies for a prospective property as well as escrow account considerations.
